4. AI Processing and Model Improvement

Swishy uses AI to help generate and edit motion designs, layouts, and animations.

A. Processing to Provide the Service

To generate outputs, your prompts and related content may be processed by:

  • Swishy systems
  • Third-party infrastructure providers (e.g., hosting, storage)
  • AI model providers (where applicable)

We only share what is necessary to operate the Service.

B. Training / Improvement

We may use de-identified and aggregated usage data (such as feature usage patterns and performance metrics) to improve the Service.

We do not use your private customer content (e.g., your projects, uploaded media, or prompts tied to your identity/workspace) to train models that are made available to other customers without your explicit consent.

If we offer an optional program to help improve models using customer content, we will provide clear disclosures and controls.

5. How We Share Information

We do not sell your personal information in the ordinary sense. We may share information in the following situations:

A. Service Providers and Vendors

We share information with vendors who help us operate the Service (e.g., hosting, databases, analytics, customer support tooling, payment processing). These providers are authorized to use information only as needed to provide services to us and must protect it.

B. Workspace Collaboration

If you use a workspace or team account, other members may be able to view information associated with shared content (e.g., your name/email and shared projects) depending on workspace settings.

C. Legal and Safety

We may disclose information if we believe it is reasonably necessary to:

  • Comply with law, court orders, or valid legal requests
  • Protect rights, property, and safety of Swishy, our users, or the public
  • Investigate fraud, security, or technical issues

D. Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.

E. With Your Direction or Consent

We may share information when you ask us to or give consent (e.g., integrations you enable).

6. Your Choices

You can:

  • Update account profile information in your settings (where available)
  • Opt out of marketing emails by using the "unsubscribe" link (service/transactional emails may still be sent)
  • Control cookies via browser settings and (where available) our cookie controls

7. Cookies, Analytics, and Advertising

A. Types of Cookies

  • Essential cookies: required for login, security, and core functionality
  • Preferences cookies: remember settings

  • Marketing cookies: measure campaigns and deliver relevant ads (if used)

B. Managing Cookies

You can disable cookies in your browser, but some features may not work correctly.

C. "Do Not Track"

Some browsers offer "Do Not Track" signals. Because there is no uniform standard, we do not respond to all such signals.

8. Data Retention

We retain personal information and content for as long as necessary to:

  • Provide the Service
  • Meet legal, accounting, or compliance requirements
  • Resolve disputes and enforce agreements

If you delete your account or request deletion, we will delete or anonymize information within a commercially reasonable period, unless legally required to retain it (e.g., for tax, fraud prevention, or compliance). Backups may persist briefly before being overwritten.

9. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect information, such as encryption in transit and access controls. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. International Data Transfers

We may process and store information in the United States and other countries where we or our service providers operate. These locations may have different data protection laws. Where required, we use appropriate safeguards for international transfers.

11. Children's Privacy

The Service is not intended for children under 13 (or the minimum age required in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will take appropriate steps to delete it.

13. Third-Party Links and Integrations

The Service may contain links to third-party sites or allow integrations. Your use of third-party services is governed by their privacy policies, not ours.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated policy and update the "Last updated" date. Your continued use of the Service after changes means you accept the updated policy.
